A good question to ask a mediator on the telephone as a screening question might be how that mediator would address a particular issue. Give the mediator one that is likely to come up in your mediation. Such as, “I want to have a prenup, and my fiancé doesn’t want one. How would you address that?” Or, “My fiancé and I are not in agreement on how we want our estate to be distributed after our death. We both have children from previous marriages.” Or you can ask the questions as to how the mediator would address an impasse without giving an example of one. Ask the mediator about the mediator’s philosophy of mediation, his her her opinion of prenups, and the mediator’s sense of the interplay beween prenups and marriage. Another reasonable question is how many prenups they have mediated in the past year or the past two years.
